Terms of Service

These terms govern your use of Optin Consent, operated by Alexis Zrimec s.p., a sole proprietor registered in Slovenia. By creating an account or starting a trial, you agree to them.

1. The service

Optin Consent is a hosted, self-optimizing marketing-consent widget. It serves a configurable consent block on your website, optimizes the wording with a multi-armed bandit, records each consent decision, and forwards accepted email addresses to your configured email service provider.

We provide the service on a subscription basis as described on our pricing page.

2. Accounts

You need an account to use the dashboard. You are responsible for the accuracy of your account details and for activity that happens under your account. Authentication is provided by our processor, Clerk.

3. Subscriptions, trials and billing

Paid plans are billed monthly in advance. Every new subscription begins with a 14-day free trial that requires a valid payment method. If you do not cancel before the trial ends, the plan converts to a paid monthly subscription at the price shown at sign-up.

Payments, invoicing and taxes are handled by our merchant of record, Paddle. Paddle is the seller of record for your subscription; Paddle.com appears on your statement and collects any applicable VAT or sales tax.

  • Starter: $29 per month, 1 site.
  • Growth: $79 per month, up to 3 sites.
  • Subscriptions renew automatically each month until cancelled.
  • Prices may change with at least 30 days notice; a change never affects the period you have already paid for.

4. Cancellation and refunds

You can cancel at any time from the dashboard, which opens the Paddle customer portal. Your plan stays active until the end of the current paid period, and we do not bill you again after cancellation.

If you are an EU, EEA, Swiss or UK consumer, you also have a statutory 14-day right to withdraw from your first payment for a full refund.

5. Your data and GDPR

You are the data controller for the personal data you collect from your site visitors through Optin Consent; we act as your data processor and process that data only on your instructions.

Our processing is described in our Privacy Policy and a Data Processing Agreement (available on request). Subscriber email addresses are relayed to your email provider in memory and are never stored on our servers.

6. Acceptable use

You agree to use Optin Consent lawfully and only to obtain genuine, freely-given marketing consent. You must not use it to deceive or pressure people into consent, and you must honour every decline and unsubscribe request. We may suspend accounts that breach these terms or applicable law.

7. Intellectual property

We retain all rights in the Optin Consent software and widget and grant you a non-exclusive, non-transferable right to use the service during your subscription. You retain all rights in your own data and content.

8. Service availability

We aim to keep the service available but do not guarantee uninterrupted operation. The widget is designed to fail open: if our API is unreachable, your site shows static fallback consent copy and no data is captured.

9. Disclaimers and limitation of liability

The service is provided on an as-is and as-available basis, without warranties of any kind, to the maximum extent permitted by law.

To the extent permitted by law, our total liability for any claim is limited to the fees you paid for the service in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

Either party may terminate by cancelling the subscription. On termination you can export your consent records, and we provide a 90-day post-cancellation export window. Retention is described in our Privacy Policy.

11. Changes to these terms

We may update these terms. Material changes will be notified by email or in the dashboard, and continued use after they take effect constitutes acceptance.

12. Governing law

These terms are governed by the laws of the Republic of Slovenia, and disputes are subject to the courts located there, without prejudice to any mandatory consumer-protection rights in your country of residence.
